The firm obtained a significant victory for its client and established a precedent -- making credit insurers liable when forms for unrequested credit insurance are presented for execution among documents in the purchase of an automobile. In American Nat'l Ins. Co. V. Paul, 927 S.W.2d 239 (Tex. App. -- Austin 1996, writ denied) the disabled purchaser of a new vehicle was awarded damages when the credit insurer refused to pay on a credit disability insurance policy surreptitiously presented to the purchaser at the time of purchase of an automobile.
